1. Acceptance of Terms

By accessing or using KEYPASS Drive, you agree to these Terms of Service. These terms apply to all guests, hosts, visitors, and account holders who use the platform. You must be at least 18 years old to create an account, list a vehicle, book a vehicle, or use any KEYPASS Drive service. If you do not agree with these terms, do not use the platform.

2. Platform Role

KEYPASS Drive is a peer-to-peer vehicle rental marketplace. The platform connects vehicle owners who list vehicles for rent (“Hosts”) with users who book vehicles for personal use (“Guests”). KEYPASS Drive does not own the vehicles listed on the platform and is not the rental car owner. Hosts are independent vehicle owners responsible for their own listings, vehicles, and trip fulfillment.

3. User Accounts

Users are responsible for maintaining the security of their account credentials. You agree to provide accurate, complete, and current information when creating an account, booking a vehicle, listing a vehicle, or contacting support. KEYPASS Drive may suspend, restrict, or terminate accounts that provide false information, violate platform rules, abuse the system, engage in fraud, or create risk for other users.

4. Host Responsibilities

Hosts are responsible for ensuring every listed vehicle has valid registration and insurance as required by applicable law. Hosts must accurately describe their vehicle, including condition, features, location, availability, rules, restrictions, mileage limits, pickup instructions, and pricing. Hosts must honor confirmed bookings unless there is a valid safety, maintenance, legal, or emergency reason. Hosts are responsible for communicating clearly with guests and providing access to the vehicle as agreed.

5. Guest Responsibilities

Guests must have a valid driver’s license and must meet all platform verification requirements before operating a booked vehicle. Guests must use vehicles responsibly and return them in the same condition received, except for normal wear from approved use. Guests are responsible for traffic violations, tolls, tickets, fines, fuel, charging, late returns, cleaning issues, damage, and other costs incurred during their trip. Guests may not allow unauthorized drivers to operate a vehicle.

6. Payments

All card payments are processed securely through Stripe. Supported crypto wallet payment options may also be offered where enabled. KEYPASS Drive does not store full card numbers on its servers. The guest platform fee is $0. The host platform fee is 8% of the trip price. Host payouts are processed according to platform payout rules and payment processor availability. Payouts are generally processed within 24 hours of trip completion when the host account is eligible, payment has cleared, and no active dispute, hold, refund, or compliance review is pending.

7. Protection Plans

Optional protection plans may be available at checkout. Protection plans are intended to help define responsibility levels and reimbursement limits for eligible trip-related incidents. These plans are not insurance policies unless formally enabled through an approved insurance or protection provider. Coverage limits, exclusions, and requirements are shown at the time of booking. Protection eligibility may depend on trip documentation, photos, timely reporting, and compliance with KEYPASS Drive rules.

8. Photos & Trip Documentation

Both guests and hosts are required to submit pre-trip and post-trip photos when requested by the platform. Photos may include vehicle exterior, interior, mileage, fuel/charge level, damage areas, cleanliness, and pickup/dropoff condition. Photos may be timestamped and stored securely. Failure to submit required photos may affect dispute eligibility, reimbursement review, damage claims, and account standing.

9. Disputes

Disputes should be opened through the platform within 72 hours of trip end unless a shorter period is required for a specific issue. KEYPASS Drive may review photos, messages, booking details, payment records, vehicle information, and other relevant evidence. For claims over $100, KEYPASS Drive aims to review submitted evidence and respond within 24 hours when enough information is available. Resolution may depend on documentation, user cooperation, payment processor rules, legal requirements, and platform policies.

10. Prohibited Uses

Users may not use vehicles for illegal activity, racing, reckless driving, rideshare or delivery services unless approved, towing unless approved, subletting, unauthorized commercial use, or allowing unapproved drivers to operate the vehicle. Smoking is prohibited unless the host explicitly permits it in the listing. Guests may not tamper with tracking, safety, lockbox, or access systems. Fraud, chargeback abuse, harassment, threats, identity misuse, and platform manipulation are prohibited.

11. Limitation of Liability

KEYPASS Drive is a marketplace platform and is not liable for accidents, injuries, vehicle damage, theft, loss, missed trips, host cancellations, guest cancellations, delays, or user misconduct beyond the limits required by law. To the maximum extent permitted by law, KEYPASS Drive’s liability is limited to the amount paid for the trip involved in the claim. Nothing in these terms limits liability that cannot legally be limited.

12. Governing Law

These Terms of Service are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Users agree that disputes involving these terms or the platform will be handled according to applicable Georgia and United States law.

13. Changes to Terms

KEYPASS Drive may update these Terms of Service at any time. Updated terms may be posted on the platform with a revised “Last updated” date. Continued use of KEYPASS Drive after updates are posted means you accept the updated terms.
